Nicholson Manufacturing Limited petitioned for a writ of mandamus to direct the Tuscaloosa Circuit Court to enter a summary judgment in its favor on the ground that Gerald Templeton's substitution of Nicholson for a fictitiously named defendant was made after the expiration of the applicable statutory limitations period and did not "relate back" to the filing of the original complaint. After review, the Supreme Court concluded Nicholson established it had a clear legal right to the relief requested. The Court granted the petition and issued the writ.
